DOCTOR OF PHILOSOPHY IN LAW (PHD)

COURSE DURATION: Three (3) years

This programme seeks to prepare students with the analytical and conceptual skills needed to understand the law in its social, economic, and political context. Students who undertake the programme will develop the requisite knowledge, confidence and skills in law to generate their scientific work and communicate the results to researchers, academicians as well as other audiences.

The global legal environment has become transnational, competitive and dynamic.  This has created a need for researchers and academics who can offer highly competent legal services that respond to the complex nature of the changing legal environment. The need to respond to these changes has triggered exponential growth in the number of students applying to undertake their PhD studies at the School of Law. The stakeholders’ meeting that was part of the curriculum review process indicated that the School of Law, as the oldest and only institution in Kenya that offers PhD studies in law, should meet this demand.

The programme seeks to produce well-grounded scholars who can offer expertise in the traditional as well as emerging areas of law that are in dire need of experts. The expertise to be developed through this programme shall build the capacity of researchers to offer advisory services at the county, national, regional, and international levels. This is in keeping with the right of quality education and training under the Constitution of Kenya 2010 as well as the Kenya Vision 2030 aspiration to develop a middle-income country in which all citizens embrace entrepreneurship, innovation and lifelong learning. The promotion of quality education and lifelong learning opportunities shall go a long way towards enhancing the achievement of Goal Number 4 of the Sustainable Development Goals (SDGs).

LEARNING OUTCOMES

At the end of this programme, a learner should be able to:

  • Demonstrate academic competencies in law;
  • Apply a critical approach to the study of law;
  • Appraise theoretical, philosophical and practical approaches to legal studies;
  • Evaluate law in its social, economic, cultural and political context.
  • Employ knowledge and research skills to carry out advanced scholarly research in law.

MODE OF DELIVERY

Face to Face Mode

Lectures, lecture discussions, class presentations, seminars, tutorials, case studies, fieldwork, role plays, simulations, students–teacher consultation, supervised independent studies, group projects, guest speakers.

Open, Distance Learning and e-learning Mode

Application of written self-instruction study modules, mediated technical learning materials, for example, audiovisual, video conferencing and e-learning platforms and online learning that utilizes video-conferencing, e-learning portals and other technological innovations

Blended Mode

Application of a combination of both face-to-face and online delivery of courses, integrating both formal and informal modes of delivery.

ADMISSION REQUIREMENTS

Minimum Admission Requirements

Applicants must satisfy the minimum University entry requirements.

The following shall be eligible for admission:

  • Subject to the University regulations, an applicant if the applicant has any of the following minimum qualifications:
  • A holder of a Master’s degree in Law from the University of Nairobi or any other institution recognized by the Senate.
  • A holder of a Master’s degree, in a field that is relevant to law, from the University of Nairobi or any other institution recognized by the Senate.
  • A holder of a doctoral degree, in a field that is relevant to law, from the University of Nairobi or any other institution recognized by the Senate.

Credit Transfers and Exemptions

No credit transfers or exemptions are allowed.

While law graduates are well-suited for specific legal careers, studying a law degree does not limit you to roles specifically in this field. Like other social science subjects, the academic challenges provided by law degrees can be good preparation for a broad range of different career paths. Other sectors you might consider as a law graduate include: accountancy, banking, business and management, commerce, finance, government, HR and recruitment, journalism, marketing and PR, media, politics, publishing, teaching, the civil service, not-for-profit and NGOs, or think tanks and policy development.

To produce qualified and morally upright diplomacy and international studies professionals, who have competence in relevant skills for effective service to both the Kenyan and international society, with decorum and prowess.

To ensure a comprehensive scope and in-depth analysis of global challenges the program is designed to include diverse issues including globalization and emerging trends in the social, economic, political, environmental and technological realms of international interaction, with a view to producing highly knowledgeable international Studies scholars; technocrats and policymakers.

Course Objectives

  • To provide students with extensive academic skills and knowledge in their areas of specialization.
  • To aid students in the development of ideas and solutions to problems that may arise in their fields of specialization over time.

Mode of Delivery

The PhD Programme is offered using two modes of delivery namely:

1. Face to Face

The methods of instruction shall be interactive and shall consist of lectures, class presentations, seminars, tutorials, case studies, fieldwork, practical sessions, student-teacher consultations, supervised independent study, group projects, guest speakers, or any combination of these.

2. Open, Distance and E-Learning (ODeL)

The Open, Distance and e-Learning Programme will run for a minimum period of seven (7) semesters and maximum of fifteen (15) semesters of fifteen (15) weeks each under the following guidelines;

i. This programme will also be offered off-campus using multi-media approaches in distance education

ii. The main media of instruction will be e-learning materials which will be provided on the online LMS for synchronous learning and will also be made available in external storage devices as back-up for asynchronous learning.

iii. The content will be uploaded on the e-learning platform after conversion into e-format to provide collaborative learning through student-student, student-instructor and evaluation interaction.

iv. The materials will be accessed through a robust Learner Management System (LMS) and other e-learning Applications (Apps) downloadable on various electronic devices.

v. There will be limited face-to-face tuition during residential sessions

vi. Learner support services including academic and technical support shall be provided using multi-media approaches and during the limited face-to-face sessions.

Course Outline

Candidates for the Doctor of Philosophy(PhD.) degree in International Studies must be:

Fees Structure

Written Examinations The common regulations for written examinations for the University of Nairobi shall apply. 1. Candidates shall have their coursework examined at the end of the semester in which the courses have been taken. 2. The assessment for each course unit shall consist of:

          a) A 3-hour end of semester written examination that shall constitute 70% of the total marks.           b) Continuous coursework assessment based on assignments, term papers and seminars that shall constitute 30% of the total marks.

3. A candidate who fails in up to one-third of the course units in an academic year shall be allowed to take supplementary examination(s) in the course unit(s) failed.

4. A pass obtained in the supplementary examination will be recorded as 50%.

5. A candidate who fails a supplementary examination shall be allowed to repeat the failed supplementary examination once.

6. A candidate who fails in more than one-third of the course units in an academic year or fails a supplementary examination at the second attempt or fails to complete the programme within the stipulated period shall, on the recommendation of the DDIS Board of Examiners and approval by the University of Nairobi Senate, be discontinued.

7. In case of an exam irregularity by any student, the CUE regulations on what constitutes an exam irregularity and the corresponding disciplinary action shall apply.

 Moderation of examinations End of semester exams are drafted by the course lecturers after which they will be submitted to the external examiner for moderation.

Thesis Regulations 1. A student must pass all course units before presenting a research proposal for approval in a faculty postgraduate committee.

2. The Chair shall forward the corrected proposal, certificate of correction, Plagiarism certificate, declaration form and where necessary ethical certificate with the Faculty Board minutes to the Graduate School requesting for full registration of the student.

3. After approval of the research proposal, the student will undertake supervised research, write and submit a thesis within the remaining period of the program. In the course of the research work, the student shall be expected to present a minimum of two seminars and publish at least two articles in a peer reviewed journal.

Thesis Examination 1. The common regulations for submission and examination of PhD thesis of the University of Nairobi shall apply.

2. The Chair of the Department shall nominate members of the thesis Board of Examiners and recommend to Graduate School for appointment in respect to each candidate defending a PhD thesis.

3. The External Examiner and Internal Examiners shall each be required to submit to the Graduate School an independent written assessment of the thesis. 4. Upon receipt of the examiners' reports, the Graduate School in consultation with the Chair of the Department shall convene a meeting of the Board of Examiners for the candidate's oral examination.

Graduation Requirements A student who will have successfully completed and passed all written exams and passed in both written and oral defence of the thesis will qualify to graduate with a PhD in International Studies.

Course Evaluation The course will be evaluated through external examiners’ reports which are expected to pint out strengths and shortcomings of the program and the way it is taught and examined. In any case the PhD Curriculum will be reviewed after every five years inconformity with the University of Nairobi regulations.

TITLE: MASTER OF LAWS

COURSE DURATION – Two (2) years

The programme provides opportunities for lawyers to develop and enhance their skills, and compete effectively in these markets, especially in the face of the emergence of new areas of legal practice and demands for highly competent legal services, and competition from lawyers from outside the region (for example, Europe, America and Canada) who are expanding/extending their services into the Kenyan and regional markets.

With this programme, the Faculty of Law seeks to take advantage of its unique expertise and aims at consolidating, harnessing and nurturing scholarship and teaching in six thematic areas of law, namely: Corporate and Financial Law; Public International Law and International Relations; Human Rights Law; Intellectual Property and Technology Law; Environment and Natural Resource Law and Democracy, Governance and Law.

LEARNING OUTCOMES

At the end of the programme, the learner should be able to: 

  • Compete effectively in a modern and dynamic legal environment
  • Provide effective legal services in new and emergent areas of law nationally, regionally and internationally
  • Prepare for careers in the academy and are equipped to transition to doctoral study
  • Conduct viable and relevant research
  • Apply law in its social, economic, cultural and political contexts.

Open, Distance Learning and e-learning Mode

Application of written self-instruction study modules, mediated technical learning materials, for example, audiovisual, video conferencing and e-learning platforms and online learning that utilizes video-conferencing, e-learning portals and other technological innovations

Blended Mode

Application of a combination of both face-to-face and online delivery of courses, integrating both formal and informal modes of delivery.

Introduction

The Master of Laws course is designed for students who are interested in gaining further skills and specializing in specific areas of law. The programme will enable students with a Bachelor’s Degree in law to delve into emerging areas of law at the national, regional and international levels.

Structure and duration

The LL.M programme consists of coursework, end of semester examinations and a project report. Teaching methods include lectures and seminars and group presentations. The programme is mounted for a minimum of three and a maximum of ten semesters of fifteen weeks each. Candidates are required to take a total of nine course units, carry out research and write a project report. These course units include three compulsory core units and at least four units in the candidates’ thematic area. The project is equivalent to four course units.

The Objectives of the Course:

i)       To enlarge and secure the future of the Faculty as a centre of excellence in legal training.

ii)      To respond to market demands by addressing emerging legal problems in light of changed legal and geopolitical terrains. 

iii)     To provide a rigorous and critical grounding in key areas of law.

iv)     To provide specialised and focused training in law at the post-graduate level.

2.0    Entry Requirements

2.1    The Common Regulations for the Master’s Degree in all Faculties, Institutes and Schools shall apply.

        The following shall be eligible for admission:

2 .2    Holders of a Bachelor of Laws degree with a minimum of an Upper Second Class Honours from the University of Nairobi.

2.3    Graduates of any other University whose degrees have been accepted by Senate to be equivalent to the Bachelor of Laws degree with qualifications specified in Regulation 2.2.

2.4    Holders of a Bachelor of Laws Degree of the University of Nairobi or its accepted equivalent who have achieved a Lower Second Class Honours and have satisfied Senate that they possess academic qualifications equivalent to Upper Second Class Honours through:

        a)      At least two years of work or relevant experience; or

        b)      Relevant research and publications; or

        c)      Attainment of a post-graduate diploma from a recognized academic institution.

3.0    Credits Transfer

A candidate may be exempted from some course units and credits transferred from institutions recognised by Senate subject to the following conditions:

3.1    They shall have passed examinations in similar course units at post-graduate master’s degree level or equivalent level.

3.2    A candidate can only transfer upto a maximum of one-third of the course units.

3.3    The candidate shall apply for exemption in writing through the Dean, School of Law to the Director of the Board of Post-graduate Studies.

3.4    The application shall be accompanied by officially endorsed, supporting academic documents.

3.5    The candidate shall pay the appropriate exemption fees to the University.

4.0    Course Structure and Duration

4.1    The programme will consist of course work, examination and a project. It will run for a minimum of three and a maximum of ten semesters of fifteen weeks each.

4.2    Candidates shall be required to take a minimum of two course units per semester and upto a maximum of five course units per semester.

4.3    Each course unit shall be taught for 60 contact hours in each semester.

4.4    Candidates shall be required to take a total of nine course units and write a research project report. These shall include three compulsory core course units and at least four course units in the area of specialization chosen. Students may take upto a maximum of two course units from an area other than the area of specialization chosen.

4.5    The research project report must be in the area of specialization and undertaken upon successful completion of the nine taught course units. It shall be equivalent to four course units.

4.6    The Senate reserves the right to require candidates to choose subjects that have a common thematic link, or which together constitute a distinct area of specialization, and to attend such other remedial courses as may be necessary for satisfactory completion of the LL.M programme.

4.7    The School reserves the right to decide which courses to offer in any academic year.

4.8    A student wishing to defer his/her admission shall write a letter to that effect to the Dean of the School stating the reasons for deferral and when he/she wishes to take up admission.

4.9    Deferrals shall not be granted beyond a period of three semesters. In case of requests for deferrals for more than three semesters, an applicant shall be required to make a fresh application.

4.10          Candidates may withdraw from the School by notifying the Director, Board of Post graduate Studies and the Dean in writing.

ADMISSION REQUIREMENTS

The following shall be eligible for admission:

  • A Bachelor of Laws degree from the University of Nairobi, Faculty of Law, with a second class honours upper division
  • An equivalent of a second class honours upper division degree in Law from a university recognized by Senate
  • A Bachelor of Laws degree from the University of Nairobi, Faculty of Law, with a minimum of a second class honours lower division and at least two (2) years work experience in a relevant field of law.
  • A Bachelor of Laws degree from a university recognized by Senate, with a minimum of a second class honours lower division and at least two (2) years’ work experience in a relevant field of law.

Credit Transfer and Exemptions

A student may be allowed credit transfer for up to one-third of the course units provided that such courses were completed in institutions recognized by the Senate.

While law graduates are well-suited for specific legal careers, studying a law degree does not limit you to roles specifically in this field. Like other social science subjects, the academic challenges provided by law degrees can be good preparation for a broad range of different career paths. Other sectors you might consider as a law graduate include: accountancy, banking, business and management, commerce, finance, government, HR and recruitment, journalism, marketing and PR, media, politics, publishing, teaching, the civil service, not-for-profit and NGOs, or think tanks and policy development.

The University of Nairobi and the University of Copenhagen  recently received a grant from the Ministry of Foreign Affairs of Denmark within the Danida Fellowship Centre framework for the project entitled: "Adaptation to climate change to improve food safety and livelihoods among pastoral communities in Kenya (ADAPTiVE) ".The Grant has provision for one (1) PhD scholarship within the area of anthropology, sociology  or similar social sciences. The successful candidate must have successfully completed the 1 st  year of course work study at the Institute of Anthropology, Gender and African Studies (IAGAS), University of Nairobi. The scholarships will cover research cost, exchange programs and a living monthly stipend and are strictly tenable for three (3) years only.
