Food is an important part of our daily lives. Food not only protects us from hunger, but the type of food that we eat is instrumental in determining our quality of health (Bourdain 11) In spite of this fact the food industry has also been used as a corporate market where large corporations can be able to maximize profits through the sale of different foods. The root question in this essay is: What is an interesting or important observation about the food industry, our connection to food, or finding success through unconventional, food-driven means. The first important observation about the food industry is the fact that in recent years, corporate entities have begun to venture into the food industry. It is important to note that in most cases the principle driving force of the corporate market is profit generation. In the light of this, many corporate firms in the food industry are not concerned about the health value of the foods that they sell to consumers (Schlosser 43). For example, the fast food market makes millions of dollars annually due to the large loyal consumer base that the industry enjoys. However, the fact remains that fast foods in most cases are not health to eat. Most fast foods are rich in cholesterol and other elements that are linked to various nutritional illnesses such as obesity. Despite the health implications that fast foods cause, consumers especially in the United States continue to purchase large quantities of fast foods both for themselves and their children. This brings up the question of what shapes our connection to food. Many food consumers in the United States and around the world are concerned with the taste of food. Many people cannot consume food that they feel does not have a sweet taste. In the light of this taste and preference by food consumers, the corporate market venturing into the food industry has over the years perfected in making sure that foods have a sweet taste. One of the ways that this has been achieved is through the addition of large quantities of sugar to various kinds of foods such as chicken. In this way, more consumers are willing to buy these foods without caring about the nutritional value of the foods or the health implications that these foods are likely to cause. Therefore, in the case of the fast food industry taste of foods is a key element in enhancing the connection of consumers to these foods. The second interesting observation of the food industry is that like other business enterprises, there is competition for consumers. In the United States for example, food industries such as MacDonald’s are located near other food outlets such as Star bucks or KFC. Therefore, one interesting observation is that food industries are located close to each other so as to give consumers a variety to choose from and to also compete for consumer traffic. Third, it is an interesting observation that many fast food industries have begun to expand their markets overseas. At the height of globalization, culture as a barrier to convergence of consumer behavior is slowly being eroded. This means that consumers around the world are beginning to have the same tastes and preferences in terms of goods and services. Due to the advancements in technology and communication, many consumers around the world have been able to learn that there are food products such as Macdonald’s that are not in their countries. As a result of the media and other forms of advertisements, many consumers around the world have begun to get a taste of food products that were initially not part of their culture. This explains why fast food firms such as Starbucks, KFC, and Macdonald’s have begun to expand their markets overseas. The expansion of these industries to overseas countries illustrates that media and advertisements is a key element in shaping our connection to food. For example, many firms in the food industry in the United States use millions of dollars each year to advertise their goods both through the mass media and social media. In this way, these food industries have been able to capture the minds of consumers and build costumer connection to the various food stuffs that these firms have to offer. Finally, owing to the competition that characterizes the food industry; various firms in the food industry have begun initiatives that are not food driven. Some of these initiatives have been corporate social responsibility in the communities that these food industries serve. These companies have engaged in activities such cleanup of the environment, and also engaging in more green ways of production. For example, a company such as Macdonald’s has begun to package its products in bio-degradable material in order to prevent environmental pollution and littering.

In California, more than half a million  fast food workers  are set to get a major raise on Monday.

Democratic Gov. Gavin Newsom signed the Fast Act back in September to require fast food chains with 60 or more locations nationwide to meet that wage increase.

"This is a big deal," Newsom said alongside union members in September. "That's 80% of the workforce."

Most of California's fast-food workers will be paid at least $20 an hour, up from $16 an hour. The bill also establishes a fast food council that will develop standards, rules, and regulations for the fast food industry.

Chains such as Chipotle and McDonald's have already said they plan to  raise menu prices  as a way to offset the costs of higher wages in California.

Advocates celebrate minimum wage bump for fast-food workers

Proponents of Assembly Bill 1228  say it will set standards for minimum sectorial wages, working hours and workplace conditions. The Service Employees International Union , a champion of the law, said that California fast-food workers are more than  twice as likely  to live in poverty than other workers, and are more likely to rely on public assistance.

In a statement from December, SEIU said, "The establishment of a Fast Food Council represents an opportunity for workers, employers and state officials to come together to help communities across the state address the rising cost of living and improve health and safety conditions on the job."

More than half a million fast-food workers will feel the effect of a pay bump – a majority of those workers being people of color, immigrants, and women. The SEIU estimated the law will apply to about 3,000 employers.

Fast food industry says expect increased costs, layoffs

Advocates for the restaurant industry fear that operating hours will reduce, prices will increase and jobs will be cut as employers deal with new labor costs. International Franchise Association President and CEO Matt Haller said restaurants are facing $250,000 in increased operating costs with the four-dollar minimum wage bump.

Jot Condie, President and CEO of the California Restaurant Association said the restaurant industry has notoriously low profit margins. "It's going to be tough to absorb these labor costs without making some adjustments." Condie said, "Their survival depends on it."

Very few of these quick service restaurants in California are corporate owned stores, Condie emphasized. "These are mostly small business owners who run these franchises."

Condie anticipates that some restaurants will adopt technologies like kiosk counters or robotics in the food prep areas in order to reduce costs.

Brian Hom is the franchise owner of two Vitality Bowls in San Jose, California. He's been operating for seven years with the help of his wife, two sons, and extended family. "We're a family business, it's not like we make big profits," said Hom.

In order to offset costs associated with the minimum wage increase, Hom is raising menu prices five to ten percent. "It's a good thing we'll bring in more revenue, but at the same time, I might have less sales because customers can't afford to eat out now," Hom said.

About 80% of Hom's employees are high school and college students. While he's happy his employees will make more money, Hom is also worried about keeping business open. "We'll have to see come Monday what the real impact is."

Advocates say there is no one-size-fits-all approach for franchises and small businesses. Those with more market leeway have more flexibility to raise prices while others fear losing customers to raised prices. They say the only alternative is to cut labor costs more. 

Restaurants making cuts are mostly pizzerias, according to a  report published by The Wall Street Journal.  Multiple businesses have plans to axe hundreds of jobs, as well as cut back hours and freeze hiring, the report shows.

Pizza Hut announced cuts to more than 1,200 delivery jobs in December.

A case for higher minimum wages without job cuts

A report from The Roosevelt Institute, a progressive think tank, found that some of the largest fast-food firms in the nation raked in record level profits over the past decade. The researchers argue that the fast-food industry's profits provide sufficient room to absorb the operating costs associated with higher wages.

Fast food prices have increased a lot faster than overall inflation, said Alí Bustamante, Deputy director of Roosevelt Institute's worker power and economic security program and co-author of the report. At the same time, the fast food industry has substantially grown since 2014: fast-food establishments in California increased by about 27.8% since 2014. And fast-food jobs increased about 20.1% between 2014 and 2022.

As the industry grew, Bustamante found that markups –the price difference between what businesses are charging and the actual cost of operating– increased over the past decade. The researchers said that profit markups paved the way for increasing profit margins in the fast-food industry.

"The industry is raking in record level profits," Bustamante said. "It really paints this picture- this has been a growing industry. But it's growing in a way that has largely focused on practices that characterize as profiteering– raising prices unnecessarily and passing those profits on to stockholders."

Economists weigh into minimum wage debate

Some economists say that raising wages for the lowest paid workers can lead to their upward mobility. The negative effects of a higher minimum wage are minimal – when wages increase by 10%, production costs in the restaurant industry usually increase by about 2% to 3%, one economist told Cal Matters.

Other economists say the cost of raising the minimum wage is job loss: while a corporation like McDonalds can afford to pay their workers higher wages, it doesn't mean they won't respond to price changes, said David Neumark, a professor of economics at the University of California, Irvine.

"These places can't function with no low-skilled labor, but they can function with less low-skilled labor," said Neumark.

The professor said that some workers will continue to keep their jobs and have minimal hours cut. Others may lose their jobs all together or see a substantial decrease in work hours.

Which workers are impacted by the California minimum wage law?

The Department of Industrial Relations published  an 18-item FAQ   in March outlining which businesses will be required to pay the new fast food minimum wage.

Those who work at a national fast food chain or coffee shop are entitled at least $20 an hour starting Monday. Here's the catch: If an employee works at a fast food establishment located inside a grocery store, they are not entitled the same pay under the law, Cal Matters reported.

“The vast majority of fast-food locations in California operate under the most profitable brands in the world,” Joseph Bryant, SEIU’s executive vice president said in a statement. “Those corporations need to pay their fair share and provide their operators with the resources they need to pay their workers a living wage without cutting jobs or passing the cost to consumers," as reported by Cal Matters.

Federal Court Enters Consent Decree Against Philips Respironics Following Recall of Certain Sleep Therapy Machines

Decree Includes Key Provisions Aimed to Prioritize Patient Relief and Ensure Company’s Regulatory Compliance

Today, the U.S. District Court for the Western District of Pennsylvania entered a consent decree of permanent injunction against Philips RS North America LLC (“Philips Respironics”), Respironics California LLC, and Philips Holding USA Inc., and Roy Jakobs, CEO of Royal Philips, along with several other individual defendants named in the decree. The consent decree , with limited exceptions, restricts the production and sale of new continuous positive airway pressure (CPAP) machines, bi-level positive airway pressure (BiPAP) machines and other devices at several Philips Respironics facilities in the United States until certain requirements are met. CPAP and BiPAP machines are sleep therapy devices used for the treatment of obstructive sleep apnea. The decree also requires implementation of a Recall Remediation Plan, agreed to by the FDA and Philips Respironics, to help ensure relief is provided to patients impacted by Philips Respironics’ June 2021 recall of certain ventilators, CPAP and BiPAP machines, by way of receiving a new or reworked/remediated device or, for certain devices, providing the option for a partial refund. 

“The finalization of this decree is a significant milestone. Throughout this recall, we have provided patients with important health information by issuing numerous safety communications and have taken actions rarely used by the agency to help protect those impacted by this recall,” said Jeff Shuren, M.D., J.D., director of the FDA's Center for Devices and Radiological Health. “Today’s action is a culmination of those efforts and includes novel provisions aimed at helping ensure that patients receive the relief they have long deserved. This also marks the first time a device company is providing a remediation payment option for a recalled device under a consent decree.”

The consent decree comes after Philips Respironics recalled certain ventilators, CPAP and BiPAP machines in June 2021 because of potential health risks—impacting 15 million devices worldwide. The polyester-based polyurethane (PE-PUR) foam used in these devices to reduce sound and vibration can break down. If the foam breaks down, black pieces of foam, or certain chemicals that are not visible, could be breathed in or swallowed by the person using the device. Immediately following Philips’ recall, the FDA issued an alert notifying device users that problems reportedly associated with the PE-PUR foam breakdown could potentially result in serious injury and may require medical intervention to prevent permanent injury. 

The complaint, filed by the Department of Justice on behalf of the FDA, alleged that Philips Respironics violated the Federal Food, Drug, and Cosmetic Act (FD&C Act) by introducing devices into interstate commerce that are adulterated because the devices were not manufactured in accordance with current good manufacturing practice requirements. In addition, the complaint alleged that the company introduced devices into interstate commerce that are misbranded because it failed to provide the FDA with information about specific corrections (or removals) the company made to devices, as required by FDA regulations. Both of these violations were noted in the FDA’s 2021 inspection of the company’s Murrysville, Pennsylvania, facility. The complaint further alleged that additional violations of current good manufacturing practice requirements were observed at Philips Respironics’ Mt. Pleasant, Pennsylvania, facility in 2023, and during several inspections of its subsidiary’s facility in Carlsbad, California, which has ceased manufacturing operations.

With certain exceptions, the consent decree restricts the Defendants from manufacturing and distributing devices at or from the Philips Respironics facilities in Pennsylvania and California, until the Defendants have completed the repair/rework, replacement and refund activities set forth in the Recall Remediation Plan, and are in compliance with requirements applicable to current good manufacturing practice, reporting corrections and removals and medical device reporting. The company must receive written notice from the FDA that they are in compliance with these requirements before resuming operations. The company can continue to manufacture and distribute certain devices that the FDA has determined to be “medically necessary,” which are specified in the decree, as well as replacement parts and accessories to support the use of devices in customers’ possession.

“Medical device manufacturers have a responsibility to comply with requirements designed to ensure the safety and effectiveness of their products,” said Principal Deputy Assistant Attorney General Brian Boynton, head of the Justice Department’s Civil Division. “Today’s action reflects our commitment to vigorously enforce federal law and prevent manufacturers from marketing adulterated and misbranded devices to vulnerable patients who need them.”

Recall Remediation Plan 

The Recall Remediation Plan outlines required remediation options based on device type, as well as timeframes for the company to complete certain remediation activities for patients impacted by this recall. More specifically, remediation options include a remediated device (either a new or reworked unit of the same model type, or a new unit of a functionally equivalent model type) with a renewed warranty or, for certain device models, issuance of a refund (factoring in depreciation of the device). As part of this plan, Philips Respironics is also required to make several attempts to contact a patient and/or Durable medical equipment provider within a certain timeframe regarding actions they must take (e.g., register the device serial number, elect a remediation option, provide prescription information, etc.) to help ensure patients receive remediation in a timely manner.

The FDA’s Center for Devices and Radiological Health (CDRH) previously issued a notice proposing that an order be issued, under section 518(b) of the FD&C Act, requiring Philips Respironics to submit a plan for the repair, replacement or refund of the purchase price (less a reasonable allowance for use) of recalled devices manufactured after November 2015. The provisions outlined in the Recall Remediation Plan agreed to by the FDA and Philips Respironics are intended to provide the relief for patients that CDRH sought through the 518(b) process. 

Key Consent Decree Provisions 

In addition to the requirements noted above, the decree contains other provisions aimed at helping to ensure patients receive relief, and that the company completes necessary testing and follows current good manufacturing practice requirements. Examples include: 

Export Restriction for Commercial Distribution

With respect to CPAP and BiPAP devices that are being used to remediate patients impacted by the recall, the decree generally prohibits the Defendants from exporting those devices for commercial distribution unless: 

  • All U.S. patients who registered by a certain date and who could be remediated with the device to be exported have been remediated; 
  • The Defendants are meeting the timeframes for steps in the remediation process set forth in the Recall Remediation Plan; and
  • The Defendants have enough devices in stock to address U.S. demand for that particular recall remediation device model for the next twelve months.  

Overall, this provision is intended to help ensure remediation of U.S. patients is prioritized over export for commercial distribution and patients receive the recall remediation devices that they are seeking from Philips Respironics in a timely manner. 

Testing Requirements

The decree also requires the Defendants to contract with an independent testing expert within 10 days of entry of the decree to review and evaluate their testing, including biocompatibility data, on the new, silicone-based foam the company is using to replace and rework some machines impacted by the June 2021 recall. This independent expert will assess, among other things, Philips’ plan for testing the silicone-based foam, including testing that has been completed, is ongoing, or is planned, to ascertain whether that testing will enable a determination that the silicone-based foam does not degrade during the labeled service life of the device and does not introduce any new or similar potential health concerns to the PE-PUR sound abatement foam. The testing expert will submit findings of this evaluation to the FDA for review. The company will be required to submit a plan to the FDA to address any gaps in testing, analysis or other information that may be identified by the expert. 

Assuring Regulatory Compliance of other Respironics’ Facilities

The consent decree also requires the Defendants to retain an independent expert to inspect their other Sleep and Respiratory Care facilities (other than the facilities in Pennsylvania and California) to evaluate whether those facilities are operating in compliance with the FD&C Act and to correct any deficiencies that are identified. In addition, the consent decree allows the FDA to subject other facilities owned by the corporate defendants to certain provisions of the decree if the FDA determines, based on a future inspection, that those facilities are not operating in compliance with the FD&C Act and its implementing regulations.

Patients impacted by the June 2021 Philips Respironics recall remain a top priority for the agency as the FDA continues to take steps to protect the health and safety of individuals using these devices. The agency continues to encourage individuals with a device affected by this recall who have not yet registered their device to do so, and those who have already registered to ensure their contact information is up to date.

The FDA has a dedicated response team that will continue to meet regularly with the company to ensure the effective and efficient implementation of the Recall Remediation Plan and other related recall activities, as outlined in the consent decree. The agency also continues to assess the supply chain for this product area and believes there is adequate supply and that alternative manufacturers are able to handle patient demand for CPAP and BiPAP machines.
