A Will is quite possibly one of the most important documents you will ever sign.

The process of making a Will at Clarke & Son is straightforward. All Wills are prepared on a fixed fee basis and the fee includes a meeting to discuss your Will, concerns and advise you on the best way to proceed or give you options, including dealing with any ancillary issues, such as property ownership, business interests, second families, tax, trusts and so on.

The draft Will is then sent to you with a detailed explanatory letter and then we move to the next meeting to get the Will signed and witnessed. In certain circumstances the Will can be sent to you for this purpose.

Free Will Healthcheck

One of the most distinguishing features of all Wills is that they require two witnesses to be valid.

It is your way of making sure that whoever you care most about in the world is the person or persons who inherits your estate on your death. 

  • You must complete your Will when you are of sound mind.
  • You will need to appoint executors, guardians and beneficiaries.
  • It is also worth considering who will inherit your estate if your chosen beneficiaries die before you or with you.

Statutory Will

Where a relative or friend is suffering from dementia and is no longer considered capable of making their wishes known, legally they do not have the capacity to make their own Will.

However, with an increasing number of such cases, the Courts do consider applications for a Statutory Will to be prepared for a person who does not have the requisite capacity.

Although these sorts of cases are still quite rare, with demographic changes and people living to an older age, there are increasing numbers of people suffering from dementia who have made no arrangements for the management of their estates on their death.

Whilst it may seem “morally wrong” or “unethical” to have a Will prepared for someone who cannot make their own decisions, the Courts are now looking more favourably on Statutory Will applications as they can help avoid unnecessary complications and expense later on. The Court will look at evidence provided by interested parties before making the Order concerning the Statutory Will.

The percentage of people making a Will in England & Wales remains low – around one in six. With people living longer and more prone to dementia-related illnesses, experts are predicting a rise in the number of Statutory Wills.

Distributing your estate

Making a Will is the only way of ensuring that after you pass away your estate is distributed as you wish it to be. If you pass without creating a Will, your estate fall under the rules of Intestacy .

Can I use my Will to take care of my pet?

Absolutely, for legal purposes your pets are viewed as your possessions and therefore you can leave your pets to named individuals or a charity. If you want to leave money to go towards your pet’s care and maintenance then this can be discussed in detail with your solicitor.

What happens to a Will when a civil partnership is converted to a marriage?

Nothing, the marriage is deemed to have existed at the point when the civil partnership was formed. Any Wills made after the civil partnership will still be valid despite the subsequent marriage.

I am due to become a parent/grandparent, can I leave assets to my unborn child/ grandchild?

Yes, you can! Your Solicitor can draft your Will to deal with any future-born children or grandchildren that might be born after the date of your Will but before the date of your death.

Can my partner and I make Wills to sign right after our marriage/civil partnership?

You can however it is much safer to have a Will prepared prior to your wedding day, which is made in contemplation of your marriage. This is because marriage automatically revokes any Will you have in place, unless your Will is specifically drafted to withstand the marriage.

At K J Smith we can draft your Will so that it is ‘made in contemplation of your marriage’ and therefore still take effect after it. This ensures that if something awful were to happen to either of you immediately after your wedding that your Will still stands.

Who can be a witness to a Will?

Witnessing a Will is a hugely important part of a Will process, and unless it is done correctly it can invalidate your Will. For this reason at K J Smith we always prefer to act as your witness to ensure that your Will is correctly executed.

A Will requires two witnesses. Each witness should be an independent person who is over 18 years. You should use someone completely unconnected to your Will, such as a neighbour or family friend, who are not referred to in the Will.

No matter what stage of life applies to you, writing and regularly updating a Will is one of the most important pieces of administration you should carry out.

Dying without having made a Will or ‘intestate’ can cause many problems, from assets being caught up in probate for very long periods to those same assets ending up in the hands of people you had no intention of benefitting.

For example; a married couple with young children where one spouse dies intestate :

As things stand the surviving spouse would receive the first £322,000 of the deceased’s estate (excluding joint assets) with the remainder being split equally between the children and survivor. Were the deceased’s estate value, passed to the children, to exceed any available nil rate band then inheritance tax at 40% could apply on the excess.

Having made the decision to make a Will, possibly for the first time, there are a few points to consider.

Before you start please consider the following:

Who will be your executor(s).

Please consider who will be the most appropriate person to act for you. Perhaps their knowledge of your family or their level of understanding of your affairs should be considered. Please remember to ask them if they will act, a refusal should not be considered an insult, some people simply would prefer not to have the responsibility.

What do you own and how?

Please consider and collate documentary evidence of your whole estate and the estimated value of the major assets such as your house, major investments, life insurance policies, pension funds and valuables. Some of these might be held with a spouse or be subject to an existing trust.

Who gets what?

It might seem obvious but without clarity, your intended beneficiaries might not get the things you intend. What if they go before you?

Burial or Cremation?

Please don’t rely solely on your Will to tell those that remain what you wish. It is often the case that the Will is read after the service. It is a good idea to tell your family occasionally “when I go I would like to be………”

Make a list

Make sure your executors or family know where the Will is kept and how they can gain access to it. You might also consider listing important items such as secure password storage for bank accounts, utilities, insurance documents etc. to accompany your Will.

Once we have recorded and collated your wishes, we will produce a draft Will document for approval or amendment. On final approval we will produce a full printed Will for signature, witness and registration.

Mirror Wills

Many couples own their assets such as the family home or bank accounts ‘jointly’ which means that on first death, these pass into the sole ownership of the survivor. For many couples considering their Wills, this structure can work well especially if the value falls below current inheritance tax thresholds and where there are no concerns about losing value to third parties such as the local authority or a new spouse.

The intent is often that once the surviving spouse has passed, some residual value will go to any children of the first marriage but, if re-marriage has occurred, the original Will becomes void and it is possible that all assets could pass outside of the original family.

The use of Mirror Wills in estate planning, whereby each party in a marriage or civil partnership leaves their share of the estate to their spouse or partner with an identical reciprocation from the other, has been common practice for many years. Such planning can begin to fail where the overall estate value, on second death, exceeds the joint allowances for inheritance tax therefore triggering a charge (which is payable prior to probate being granted).

Recently, Will writers have added a simple trust to their proposal in-order to create a ‘life interest’ for a surviving spouse. The life interest trust is created to allow the surviving spouse to enjoy the value of their departed’s assets without them becoming part of their own estate. The assets held within the life interest trust would ordinarily pass to the children or other intended recipients on second death without the worry of third party influence.

Such planning relies on the splitting of ownership of the family home into ‘tenants in common’ and selected other assets being held in sole name rather than jointly.
