"Effect" is most often a noun and generally means “a result.” However, "effect" can be used as a verb that essentially means "to bring about," or "to accomplish." The word "affect" is almost always a verb and generally means "to influence." However, affect can be used as a noun when you're talking about the mood that someone appears to have. [Ugh!]
  • Apostrophes -- the position of an apostrophe depends upon whether the noun is singular or plural. For singular words, add an "s" to the end, even if the final letter is an "s." For contractions, replace missing letters with an apostrophe; but remember that it is where the letters no longer are, which is not always where the words are joined [e.g., "is not" and "isn't"]. Note that contractions are rarely used in scholarly writing.
  • Capitalization -- a person’s title is capitalized when it precedes the name and, thus, is seen as part of the name [e.g., President Zachary Taylor]; once the title occurs, further references to the person holding the title appear in lowercase [e.g., the president]. For groups or organizations, the name is capitalized when it is the full name [e.g., the United States Department of Justice]; further references should be written in lowercase [e.g., the department]. In general, the use of capital letters should be minimized as much as possible.
  • Colorless verbs and bland adjectives –- passive voice, use of the to be verb, is a lost opportunity to use a more interesting and accurate verb when you can. Adjectives can also be used very specifically to add to the sentence. Try to avoid generic or bland adjectives and be specific. Use adjectives that add to the meaning of the sentence.
  • Comma splices -- a comma splice is the incorrect use of a comma to connect two independent clauses (an independent clause is a phrase that is grammatically and conceptually complete: that is, it can stand on its own as a sentence). To correct the comma splice, you can: replace the comma with a period, forming two sentences; replace the comma with a semicolon; or, join the two clauses with a conjunction such as "and," "because," "but," etc.
  • Compared with vs. compared to -- compare to is to point out or imply resemblances between objects regarded as essentially of a different order; compare with is mainly to point out differences between objects regarded as essentially of the same order [e.g., life has been compared to a journey; Congress may be compared with the British Parliament].
  • Confusing singular possessive and plural nouns –- singular possessive nouns always take an apostrophe, with few exceptions, and plural nouns never take an apostrophe. Omitting an apostrophe or adding one where it does not belong makes the sentence unclear.
  • Coordinating conjunctions -- words, such as "but," "and," "yet," join grammatically similar elements [i.e., two nouns, two verbs, two modifiers, two independent clauses]. Be sure that the elements they join are equal in importance and in structure.
  • Dangling participial -- a participial phrase at the beginning of a sentence must refer to the grammatical subject of the sentence.
  • Dropped commas around clauses –-place commas around words, phrases, or clauses that interrupt a sentence. Do not use commas around restrictive clauses, which provide essential information about the subject of the sentence.
  • The Existential "this" -- always include a referent with "this," such as "this theory..." or "this approach to understanding the...." With no referent, "this" can confuse the reader.
  • The Existential "it" -- the "existential it" gives no reference for what "it" is. Be specific!
  • Its / it's --"its" is the possessive form of "it." "It's" is the contraction of "it is" or "it has." They are not interchangeable and the latter should be avoided in scholarly writing.
  • Fewer / Less -- if you can count it, then use the word fewer; if you cannot count it, use the word less.
  • Interrupting clause –- this clause or phrase interrupts a sentence, such as, "however." Place a comma on either side of the interrupting clause. An interrupting clause should generally be avoided in academic writing.
  • Know your non-restrictive clauses –- this clause or phrase modifies the subject of the sentence, but it is not essential to understanding the sentence. The word “which” is the relative pronoun usually used to introduce the nonrestrictive clause.
  • Know your restrictive clauses –- this clause limits the meaning of the nouns it modifies. The restrictive clause introduces information that is essential to understanding the meaning of the sentence. The word “that” is the relative pronoun normally used to introduce this clause. Without this clause or phrase, the meaning of the sentence changes.
  • Literally -- this word means that exactly what you say is true, no metaphors or analogies. Be aware of this if you are using "literally" to describe something. The term literally should never be applied to subjective expressions [i.e., "literally the most comfortable meeting"] or to imprecise measurements [i.e., "literally dozens of protesters"].
  • Lonely quotes –- unlike in journalistic writing, quotes in scholarly writing cannot stand on their own as a sentence. Integrate them into a paragraph.
  • Misuse and abuse of semicolons –- semicolons are used to separate two related independent clauses or to separate items in a list that contains commas. Do not abuse semicolons by using them often; they are best used sparingly.
  • Overuse of unspecific determinates -- words such as "super" [as in super strong] or "very" [as in very strong], are unspecific determinates. How many/much is "very"? How incredibly awesome is super? If you ask ten people how cold, "very cold" is, you would get ten different answers. Academic writing should be precise, so eliminate as many unspecific determinants as possible.
  • Semicolon usage -- a semicolon is most often used to separate two complete but closely related clauses. Consider the semicolon as marking a shorter pause than a period but a longer pause than a comma (this is easy to remember since a semicolon is the combination of a period and a comma). In the same way, semicolons are also used to separate complicated lists of three or more items.
  • Sentence fragments –- these occur when a dependent clause is punctuated as a complete sentence. Dependent clauses must be used together with an independent clause.
  • Singular words that sound plural -- when using words like "each," "every," "everybody," "nobody," or "anybody" in a sentence, we're likely thinking about more than one person or thing. But all these words are grammatically singular: they refer to just one person or thing at a time. And unfortunately, if you change the verb to correct the grammar, you create a pedantic phrase like "he or she" or "his or her."
  • Split Infinitive -- an infinitive is the form of a verb that begins with "to." Splitting an infinitive means placing another word or words between the "to" and the infinitive verb. This is considered incorrect by purists, but nowadays it is considered a matter of style rather than poor grammar. Nevertheless, in academic writing, it's best to avoid split infinitives.
  • Subject/pronoun disagreement –- there are two types of subject/pronoun disagreements. Shifts in number refer to the shifting between singular and plural in the same sentence. Be consistent. Shifts in person occurs when the person shifts within the sentence from first to second person, from second to third person, etc.
  • That vs. which -- that clauses (called restrictive) are essential to the meaning of the sentence; which clauses (called nonrestrictive) merely add additional information. In general, most nonrestrictive clauses in academic writing are incorrect or superfluous. While proofreading, go on a "which" hunt and turn most of them into restrictive clauses. Also, "that" never follows a comma but "which" does.
  • Verb Tense Agreement -- this refers to keeping the same tense [past, present, future] throughout a clause. Do not shift from one tense to another if the time for each action or event is the same. Note that, when referring to separate actions or events, the tenses may be different.
  • Who / whom -- who is used as the subject of the clause it introduces; whom is used as the object of a preposition, as a direct object, or as an indirect object. A key to remembering which word to use is to simply substitute who or whom with a pronoun. If you can substitute he, she, we, or they in the clause, and it still sounds okay, then you know that who is the correct word to use. If, however, him, her, us, or them sounds more appropriate, then whom is the correct choice for the sentence.

Grammar and Spell Check Programs Are Not Infallible

A basic proofreading strategy is to use the spelling and grammar check tools available from your word processing programs. This can be a quick way to catch misspelled words, unintentionally repeated words [e.g., "the the"], different spellings of proper nouns, or identify incorrect grammar and sentence construction. These tools, however, are not perfect. Always proofread what has been “corrected” after running a spell or grammar program for the following reasons:

Spell Checkers : There are several limitations to be aware of. Research has shown that “spell checkers alone cannot eliminate the written expression deficits of many students with learning disabilities” [Montgomery, 2001: 28]. Examples of this can include identifying contextual errors, such as, writing “then” for "than" or misusing homophones, such as, “to,” “too,” or “two.” If you have a learning disability, be extra aware of these issues when running a spell checker. Also, the level of a mismatch between a misspelled word and the target word provided in the list of suggested words determines whether the target word is available to choose from [or whether there are no suggestions]. In these cases, correct the word as best you can and rerun the spell checker to see if the target word appears or use a different word with the same meaning. Finally, if computer-assisted spell checking identifies two or more spellings of a proper noun in your paper [e.g.,  Allison, Alison ], then you will need to independently confirm the correct spelling. This is particularly important for proper nouns of people, places, or things derived from languages other than English if that is your first language.

Grammar Checkers : Beyond correcting obvious errors, these tools will suggest how to rearrange text based on the preferred way of writing a sentence. This, however, does not necessarily mean the sentence was grammatically incorrect to begin with; the program's algorithm may have been tagged it as “awkward.” The word structure of English can be arranged in different ways while retaining the meaning of a sentence. Therefore, if you accept a grammar checker’s changes, review the new sentence and determine if the auto corrected text still reflects the context of what you want to say and how you want to say it. Also, check the narrative flow of the paragraph. Does the preceding and following sentences around the new text still retain the narrative flow that you originally intended [i.e., the author's voice]? If not, you may need to further edit the paragraph.

Stanford's own Andrea Lunsford, Louise Hewett Nixon Professor of English, is a leader in the study of error in writing. Her long-term quantitative research has revealed shifting patterns of error as technologies and rhetorical situations change. Among Professor Lunsford's findings ( summarized in Top 20 form here ):

  • Student papers today are longer and more complex than they were 20 years ago, yet there has been no significant increase in the overall rate of error.
  • Although word-processing tools have advanced substantially, they are responsible for the most common error in student writing today: using the wrong word, spelled correctly.

What do you think of when you think of the word "grammar"? Laura Micciche argues most people think of formal grammar: "Usually, our minds go to those unending rules and exceptions, those repetitive drills and worksheets..." (720). This formal grammar is "the deadly kind of grammar," the one that makes us anxious. Drawing on Martha Kolln's idea of "rhetorical grammar," Micciche argues that grammar doesn't have to be deadly: it can give a writer more powerful choices, and thus make writing and communicating more satisfying and more pleasurable.

Williams, Joseph M. "The Phenomenology of Error." College Composition and Communication 32.2 (May 1981): 152-168.

Why do some grammatical errors seem to cause so much venom and rage? Why is a misuse of the word "hopefully" considered an "atrocity"? Joseph M. Williams examined this question in this still-relevant 1981 article. Williams is also the author of Style: Ten Lessons in Clarity and Grace (Longman).

ABSTRACT A growing body of curriculum development, instruction, and research focuses on ways of attending to grammar systematically in content-based academic English programs (Coffin, 2010). This work examines the functions of the grammatical structures to be learned to express particular meanings in oral and written texts within and beyond sentences in authentic discourse contexts (Derewianka & Jones, 2012). Content areas in which explicit grammatical instruction has been integrated successfully include social studies, history, geography, English, and mathematics in K-12 and higher education programs (e.g., Christie, 2004; Mohan, 1986; Schleppegrell, Achugar & Oteíza, 2004). In this chapter, we first discuss the changing contexts for the teaching of English grammar across educational programs and curriculum worldwide, particularly with relatively advanced learners engaged in English-medium instruction (i.e., content and language integrated learning). Next, we discuss traditional approaches to grammar instruction and research and then review some promising functional approaches being taken up by language educators and content specialists in the US, Australia, and other countries, and at our own institution in Canada. We provide theoretical and research foundations and examples of the implementation and effectiveness of such approaches to the teaching and learning of (discourse) grammar by examining nominalization and grammatical metaphor, for example. We conclude by discussing some implications of developments in this area for teacher education--for language instructors, teacher educators, and content specialists--as well as for program development and future research on grammar instruction.

This article examines a number of adult ESL grammar textbooks via an author designed checklist to analyze how well they incorporate the findings from research in communicative language teaching (CLT) and in form1ocused instruction (FFI). It concludes that although a few textbooks incorporate some of the research findings in CLT and FFI, they are not necessarily those chosen by the teaching institutions.

The present paper reports on a study that was carried out to compare the effectiveness of three instructional techniques, namely dialogues, focused tasks, and games on teaching grammar. The participants were 48 pre-intermediate EFL students that formed three experimental groups. A posttest consisting of 20 productive items was administered at the end of the treatment period which lasted for four sessions. The results revealed no statistically significant difference between the three groups. This suggests that the three instructional techniques had relatively the same effect on the accurate grammatical production of the learners.

Schenck, Andrew. An Investigation of the Relationship Between Grammar Type and Efficacy of Form-Focused Instruction. The New Studies of English Language & Literature 69 (2018): 223-248. Because phonological, semantic, and morphosyntactic characteristics of grammatical features can have a significant impact on form-focused instruction, utilization of different grammatical features to test new language teaching techniques may conflate determinations of efficacy or inefficacy. The purpose of this study was to holistically examine different types of instruction, comparing them with grammatical features to evaluate effectiveness. Forty-six experimental studies of form-focused instruction were selected for study. Comparison of effect sizes suggests that the efficacy of form-focused instruction differs considerably based upon the type of grammatical feature targeted. Input-based instruction (e.g.,input enhancement or explicit rule presentation) appears more useful for features like the plural -s, past -ed, and third person singular -s, which are phonologically insalient, yet morphologically regular. Output-based instruction (e.g., corrective feedback or recasts), in contrast, appears more effective with grammatical features such as questions, phrasal verbs, conditionals, and articles, which are syntactically or semantically complex. Overall, the results suggest that differences in grammar be considered before curricula or pedagogical interventions are designed. (State University of New York, Korea)

International Journal of English Language Teaching

This paper unravels aspects of English grammar to be reinforced in the teaching of English as a second or foreign language. The data sources for the study are the following: the broad corpus which consists of 392 BEPC exam essays (2014 and 2015), 46 class test essays (15 in 2016, 15 in 2017 and 16 in 2018) and the narrow corpus which consists of a series of ten (10) designed tests altogether intended for 100 Troisieme class pupils (administered in 2019). The framework used for this study is the Communicative Effect Taxonomy in error analysis as developed by Hendrickson (1976). Findings revealed that Troisieme pupils' English is strewn with global errors, local errors and ambiguous errors. Actually, 20 global error types (including the choice of the wrong auxiliary), 14 local error types (including the V-ed form attached to irregular verbs) and 9 types of ambiguous errors (including the use of the preposition 'at' in place of 'about') were identified in the broad corpus and highlighted in the narrow corpus. By doing so, Troisieme pupils' communicative proficiency as well as their linguistic proficiency was found to be low, and their communicative proficiency was found to be lower than their linguistic proficiency. From the above aspects of English grammar to be reinforced in the teaching of English as a second or foreign language were unveiled. The essence of it all is to improve communicative and linguistic proficiency in English.

Plagiarism in peer-review reports could be the ‘tip of the iceberg’

Mikołaj Piniewski is a researcher to whom PhD students and collaborators turn when they need to revise or refine a manuscript. The hydrologist, at the Warsaw University of Life Sciences, has a keen eye for problems in text — a skill that came in handy last year when he encountered some suspicious writing in peer-review reports of his own paper.

Last May, when Piniewski was reading the peer-review feedback that he and his co-authors had received for a manuscript they’d submitted to an environmental-science journal, alarm bells started ringing in his head. Comments by two of the three reviewers were vague and lacked substance, so Piniewski decided to run a Google search, looking at specific phrases and quotes the reviewers had used.

To his surprise, he found the comments were identical to those that were already available on the Internet, in multiple open-access review reports from publishers such as MDPI and PLOS. “I was speechless,” says Piniewski. The revelation caused him to go back to another manuscript that he had submitted a few months earlier, and dig out the peer-review reports he received for that. He found more plagiarized text. After e-mailing several collaborators, he assembled a team to dig deeper.

Meet this super-spotter of duplicated images in science papers

The team published the results of its investigation in Scientometrics in February 1 , examining dozens of cases of apparent plagiarism in peer-review reports, identifying the use of identical phrases across reports prepared for 19 journals. The team discovered exact quotes duplicated across 50 publications, saying that the findings are just “the tip of the iceberg” when it comes to misconduct in the peer-review system.

Dorothy Bishop, a former neuroscientist at the University of Oxford, UK, who has turned her attention to investigating research misconduct, was “favourably impressed” by the team’s analysis. “I felt the way they approached it was quite useful and might be a guide for other people trying to pin this stuff down,” she says.

Piniewski and his colleagues conducted three analyses. First, they uploaded five peer-review reports from the two manuscripts that his laboratory had submitted to a rudimentary online plagiarism-detection tool . The reports had 44–100% similarity to previously published online content. Links were provided to the sources in which duplications were found.

The researchers drilled down further. They broke one of the suspicious peer-review reports down to fragments of one to three sentences each and searched for them on Google. In seconds, the search engine returned a number of hits: the exact phrases appeared in 22 open peer-review reports, published between 2021 and 2023.

The final analysis provided the most worrying results. They took a single quote — 43 words long and featuring multiple language errors, including incorrect capitalization — and pasted it into Google. The search revealed that the quote, or variants of it, had been used in 50 peer-review reports.

Predominantly, these reports were from journals published by MDPI, PLOS and Elsevier, and the team found that the amount of duplication increased year-on-year between 2021 and 2023. Whether this is because of an increase in the number of open-access peer-review reports during this time or an indication of a growing problem is unclear — but Piniewski thinks that it could be a little bit of both.

Why would a peer reviewer use plagiarized text in their report? The team says that some might be attempting to save time , whereas others could be motivated by a lack of confidence in their writing ability, for example, if they aren’t fluent in English.

The team notes that there are instances that might not represent misconduct. “A tolerable rephrasing of your own words from a different review? I think that’s fine,” says Piniewski. “But I imagine that most of these cases we found are actually something else.”

The source of the problem

Duplication and manipulation of peer-review reports is not a new phenomenon. “I think it’s now increasingly recognized that the manipulation of the peer-review process, which was recognized around 2010, was probably an indication of paper mills operating at that point,” says Jennifer Byrne, director of biobanking at New South Wales Health in Sydney, Australia, who also studies research integrity in scientific literature.

Paper mills — organizations that churn out fake research papers and sell authorships to turn a profit — have been known to tamper with reviews to push manuscripts through to publication, says Byrne.

However, when Bishop looked at Piniewski’s case, she could not find any overt evidence of paper-mill activity. Rather, she suspects that journal editors might be involved in cases of peer-review-report duplication and suggests studying the track records of those who’ve allowed inadequate or plagiarized reports to proliferate.

Piniewski’s team is also concerned about the rise of duplications as generative artificial intelligence (AI) becomes easier to access . Although his team didn’t look for signs of AI use, its ability to quickly ingest and rephrase large swathes of text is seen as an emerging issue.

A preprint posted in March 2 showed evidence of researchers using AI chatbots to assist with peer review, identifying specific adjectives that could be hallmarks of AI-written text in peer-review reports .

Bishop isn’t as concerned as Piniewski about AI-generated reports, saying that it’s easy to distinguish between AI-generated text and legitimate reviewer commentary. “The beautiful thing about peer review,” she says, is that it is “one thing you couldn’t do a credible job with AI”.

Preventing plagiarism

Publishers seem to be taking action. Bethany Baker, a media-relations manager at PLOS, who is based in Cambridge, UK, told Nature Index that the PLOS Publication Ethics team “is investigating the concerns raised in the Scientometrics article about potential plagiarism in peer reviews”.

How big is science’s fake-paper problem?

An Elsevier representative told Nature Index that the publisher “can confirm that this matter has been brought to our attention and we are conducting an investigation”.

In a statement, the MDPI Research Integrity and Publication Ethics Team said that it has been made aware of potential misconduct by reviewers in its journals and is “actively addressing and investigating this issue”. It did not confirm whether this was related to the Scientometrics article.

One proposed solution to the problem is ensuring that all submitted reviews are checked using plagiarism-detection software. In 2022, exploratory work by Adam Day, a data scientist at Sage Publications, based in Thousand Oaks, California, identified duplicated text in peer-review reports that might be suggestive of paper-mill activity. Day offered a similar solution of using anti-plagiarism software , such as Turnitin.

Piniewski expects the problem to get worse in the coming years, but he hasn’t received any unusual peer-review reports since those that originally sparked his research. Still, he says that he’s now even more vigilant. “If something unusual occurs, I will spot it.”

Geophysical Research Letters is a gold open access journal that publishes high-impact, innovative and timely communications-length articles on major advances spanning all of the major geoscience disciplines.

The paper, “ Causes of Higher Climate Sensitivity in CMIP6 Models ,” was co-written with Mark Zelinka, a research scientist for Lawrence Livermore National Laboratory at the University of Washington. The paper discusses the ability to predict how much the earth warms in response to changes in greenhouse gas using Earth system models (ESMs).

“I was really pleased to see this paper selected by the Geophysical Research Letters editorial board,” says McCoy, who works in UW’s Department of Atmospheric Science. “At the time when Mark Zelinka reached out to me to collaborate, it was clear that he had identified a big shift in how our models were representing future climate and that it was important to disseminate it to the community.”

Other contributors to the paper were Timothy Myers, who works in the Physical Sciences Laboratory at the National Oceanic and Atmospheric Administration; Paulo Ceppi, a senior lecturer of climate science at Imperial College London; and Stephen Po-Chedley, a research scientist; Peter Caldwell, Climate Modeling Group leader and staff scientist; Stephen Klein, an atmospheric research scientist; and Karl Taylor, director of the Program for Climate Model Diagnosis and Intercomparison, all of Lawrence Livermore National Laboratory.

“When I saw the initial results that cloud feedback had gotten more amplifying in the latest models, I immediately reached out to Daniel for his help in interpreting them since his previous work had greatly influenced my thinking,” Zelinka says. “He provided useful calculations to strengthen our case that changes in the cloud liquid content were a key part of the story in leading to a new class of highly sensitive models.”

The group found that the temperature response to an abrupt quadrupling of atmospheric CO 2 has increased substantially in the latest generation of global climate models relative to previous generations. This is primarily because cloud water content and coverage decrease more strongly with global warming, causing enhanced planetary absorption of sunlight -- amplifying feedback that ultimately results in more warming. Differences in the physical representation of clouds in ESMs drive this enhanced sensitivity relative to the previous generation of models.

“It was really exciting to be part of this study. What Mark and my co-authors showed in this paper is that an important source of ESM uncertainty on a time scale that matters to the near future are these difficult-to-treat, small-scale processes, such as clouds, convection, aerosol and precipitation,” McCoy says. “It allows us to identify and target specific processes that have a lot of leverage on our predictions of future climate for observations and for continued model development and evaluation.”

Since its publication in 2020, the paper has exceeded 1,000 citations, placing it in the top 1 percent of geoscience articles.

UW will host a US Climate Variability and Predictability workshop, titled “ Micro2Macro: Origins of Climate Change Uncertainty ,” Oct. 28-30. The workshop will address issues related to McCoy’s representation of microscale processes in global ESMs.

McCoy is director of the Perturbed Physics Ensemble Regression Optimization Center for ESM Evaluation and Development ( PROCEED ), a collaboration among the UW Department of Atmospheric Science; the UW School of Computing; the University of Hawaii-Manoa; Pacific Northwest National Laboratory; and Lawrence Livermore National Laboratory. PROCEED seeks to leverage UW’s unique access to the National Center for Atmospheric Research-Wyoming Supercomputing Center to reduce uncertainty related to subgrid phenomena in ESMs.

Reshoring, Automation, and Labor Markets Under Trade Uncertainty

We study the implications of trade uncertainty for reshoring, automation, and U.S. labor markets. Rising trade uncertainty creates incentive for firms to reduce exposures to foreign suppliers by moving production and distribution processes to domestic producers. However, we argue that reshoring does not necessarily bring jobs back to the home country or boost domestic wages, especially when firms have access to labor-substituting technologies such as automation. Automation improves labor productivity and facilitates reshoring, but it can also displace jobs. Furthermore, automation poses a threat that weakens the bargaining power of low-skilled workers in wage negotiations, depressing their wages and raising the skill premium and wage inequality. The model predictions are in line with industry-level empirical evidence.

Executive Summary

As we laid out in a previous article , the process for the permitting of renewable energy generation and electric transmission projects in the United States is multi-layered and often extremely long. If the U.S. is to achieve its climate ambitions and fully implement transformative legislation like the Inflation Reduction Act, Congress will also have to enable a massively accelerated build-out of clean energy infrastructure.

At the same time, valuable environmental safeguards, and the established public participatory and related administrative processes used to adopt and implement them, cannot simply be sidestepped. Congress should approach federal permitting reform in a way that maximizes efficiency in government decisionmaking through shorter timelines for regulatory approvals without sacrificing the value of the current process in protecting the environment and local stakeholders. Further, it is essential that reforms are evidence-based in targeting the major sources of current delays. Our research in this article indicates that striking such a balance is possible—a targeted set of six reforms laid out here could significantly accelerate federal permitting for clean energy infrastructure, without compromising environmental protections.

Permitting reforms will also need to be able to attract bipartisan support to pass through Congress. The most recent high-profile attempt at permitting reform by Senator Joe Manchin (D-WV) was not palatable to both progressive Democrats , who argued it would eliminate environmental protections, and to Republicans , who, among other concerns, argued that it was a federal power grab and that it did not go far enough in reducing regulatory red tape.

In this article, we provide an analysis of the specific points of delay within the federal permitting process for clean energy infrastructure. We then discuss six major areas of potential reform, including evaluations of existing reform provisions on the table, such as Senator Manchin’s proposed legislation. In each area, we provide policy options that would make a significant impact on shortening permitting timelines, avoid affecting the integrity of environmental review, and attract support across the political spectrum. We conclude with options for permitting reform at the local and state levels, both of which have important planning and compliance roles in clean energy infrastructure development, making them critical pieces of the puzzle. Below are the highlights of the policy options we present:

Policy Roadmap

  • Under such a program, Congress could direct federal land-management agencies to prepare national-level maps of environmental sensitivity, with corresponding pre-designated “go-to areas” for renewable energy projects in areas of lowest environmental sensitivity.
  • Congress could also direct federal land-management agencies to prepare programmatic environmental impact statement reports for low-sensitivity areas with high potential for renewable energy infrastructure, and if it does so, it should appropriate sufficient funding for these mapping and reviewing functions.
  • Furthermore, the U.S. Army Corps of Engineers could expand Clean Water Act Section 404 general permitting to include offshore wind transmission line construction.
  • Siting authority for all interstate transmission lines could be federalized with the Federal Energy Regulatory Commission (FERC). Interstate transmission lines are critical for decarbonization of the U.S., with national benefits but local costs, that are frequently rejected by state authorities. Natural gas pipelines have similar cost-benefit tradeoffs, but they are permitted much faster due to FERC’s existing siting authority over them. Expanding FERC’s partial, pre-existing backstop authority over transmission lines to complete siting authority is therefore a step with precedent and high expected benefits. FERC could also ensure that interstate transmission lines allocate a fair fraction of their capacity to the states and communities through which they pass, thereby increasing local support for transmission and more equitably distributing its benefits.
  • The Biden administration could conduct a staff capacity, funding, and technology needs assessment across agencies involved with critical permitting for clean energy. If the assessment finds substantial gaps, Congress could appropriate funds to increase resources available to these agencies, earmarking them for permitting capacity.
  • Congress could transfer initial authority for Clean Air Act permitting for offshore wind from the Environmental Protection Agency (EPA) to the Bureau of Ocean Energy Management (BOEM) within the Department of the Interior. Such a step would help shorten a part of the permitting timeline for offshore wind and bring it on fairer footing with the treatment of Clean Air Act permitting for offshore fossil fuel production, an industry that generates much more pollution. Congress could also create a separate legislative title for offshore wind under the Outer Continental Shelf Lands Act (OCSLA), thereby improving planning, permitting, and leasing processes.
  • Congress could support multi-agency coordination by allocating additional funding to the Federal Permitting Improvement Steering Council (FPISC) , and by expanding its scope to cover mid-sized as well as large clean energy projects. Further, all agencies could adopt the process of lead agency coordination of multi-agency reviews created by Title 41 of the Fixing America’s Surface Transportation Act (FAST-41).
  • Narrow expansions of categorical exclusions under NEPA, as detailed by the Bipartisan Policy Center, are likely to accelerate some permitting actions. An overly aggressive expansion of categorical exclusions may not have beneficial effects, as categorical exclusions are already widely used, and misclassifying projects that deserve a higher level of review may not necessarily shorten permitting timelines.
  • Strict and automatically-enforced NEPA time limits for pre-designated low-environmental-sensitivity areas for clean energy infrastructure, modeled on a recent European Union plan, are likely to significantly accelerate clean energy permitting and deployment. Broader time or page limits on NEPA reviews without further study and targeting are unlikely to be helpful.
  • Congress could direct legal challenges to solar, wind, and transmission infrastructure Environmental Impact Statements (EIS) directly to the federal Court of Appeals for the D.C. Circuit to expedite approval of large clean energy infrastructure projects, as suggested by James Coleman. Any broader limitations on NEPA litigation may have unintended consequences, as the evidence of excessive frivolous litigation or excessive litigation-induced delay is currently mixed.
